CALL FOR APPLICATION FOR LICENCE TO OPERATE COLLECTIVE MANAGEMENT ORGANIZATIONS (CMOs) FOR THE CATEGORY OF LITERARY WORKS, FILMS, VISUAL ARTS AND PERFORMING ARTS IN TANZANIA MAINLAND
Following the amendment of the Copyright and Neighbouring Rights Act No. 7 of 1999 through Finance Act No.5 of the year 2022 allows the establishment of Collective Management Organizations (CMOs) for Collection and Distribution of Copyright Royalties.
The Office would like to invite all entities interested to operate as CMOs for the Category of Literary Works, Films, Visual Arts and Performing Arts in Tanzania Mainland for the year 2023/2024 to submit an official application to COSOTA in accordance with the criteria found in The Copyright and Neighbouring Rights Act (Collective Management Organizations) Regulations of 2023, GN No 211 and 215 published on March 24, 2023. These regulations are also available at the Office website: www.cosota.go.tz.
The conditions for being granted a licence are as follows:-
1. Owners must be citizens of Tanzania (Submit the Company Director’s Identity like NIDA, Travel Passport).
2. Members’ passport size.
3. Tax Identification Number (TIN) from Tanzania Revenue Authority (TRA).
4. Tax clearance certificate.
5. Valid business license.
6. Certificate of registration of the company from BRELA.
7. The organization must be incorporated under the Companies Act (Certificate of Incorporation).
8. Memorandum and Articles of Association.
9. Members Curriculum Vitae.
10. Provide the Performance Bond/Collateral of value not less than Tsh. 250,000,000.
11. Provide a business plan that demonstrates your ability to fairly collect and manage royalties.
12. Contains at least 30 members who want to represent (along with their names, signatures, and contact information).
13. The company has never been found guilty of tax evasion or economic sabotage.
14. Compliance with other national statutory regulations (No. 13 and 14 – Submit “Declaration of Oath”).
